Terms of Service

These Terms of Service ("Terms") govern your access to and use of BloomWed (the "Service"), operated by Nicolaas Jacobus Robbertse and Theunis Gerhardus Kerry ("BloomWed", "we", "us", or "our"). By creating an account, publishing a wedding website, listing a business, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use BloomWed

You must be at least 18 years old and able to form a binding contract under South African law to use the Service. BloomWed is offered to two types of users: couples planning a wedding ("Couples") and wedding businesses listing their services in the marketplace ("Vendors"). Some features may only be available to one user type.

2. Accounts

You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us immediately at hello@bloomwed.co.za if you suspect unauthorised use of your account.

3. Couple packages and payment

Couples select a once-off package (Save the Date, Essential, or Complete) to publish their wedding website. Prices are shown in South African Rand (ZAR) and are inclusive of any applicable taxes unless stated otherwise. Payment is currently made by direct bank transfer (EFT) to BloomWed's bank account, using a unique reference provided at checkout; access unlocks once we confirm receipt. A wedding website remains in draft, editable but not publicly visible, until payment for a package is completed. Once-off payments are for access to the selected package's features for your wedding; they are not a recurring subscription.

4. Vendor listings

Vendor listings are currently offered free of charge while BloomWed is in its early launch phase. Paid subscription tiers (Basic, Standard, and Featured) will be introduced in future — existing vendors will be notified in advance of any billing changes before being charged.

5. Refunds and cancellations

Because Couple packages unlock digital access immediately on payment, fees are generally non-refundable once a website has been published. If you believe you were charged in error, contact us at hello@bloomwed.co.za and we will review the request. This does not affect any statutory rights you have under the Consumer Protection Act 68 of 2008.

6. User content

You retain ownership of the photos, text, guest lists, and other content you upload ("User Content"). By uploading content, you grant BloomWed a non-exclusive, royalty-free licence to host, store, display, and transmit that content solely for the purpose of operating and providing the Service to you and, where you choose to make a page public, to your invited guests. You are responsible for ensuring you have the right to upload and share any content you submit, including photos of guests uploaded to a shared gallery.

7. Acceptable use

You agree not to use the Service to:

  • Upload unlawful, defamatory, obscene, or infringing content;
  • Send unsolicited bulk messages or spam via WhatsApp, email, or otherwise;
  • Impersonate another person or misrepresent your affiliation with any Vendor;
  • Attempt to gain unauthorised access to another user's account or data;
  • Scrape, resell, or misuse marketplace listings or guest data.

8. Vendor listings and marketplace

Vendors are solely responsible for the accuracy of their listings, pricing, and portfolio content. BloomWed does not vet, endorse, or guarantee the quality of any Vendor's services and is not a party to any agreement between a Couple and a Vendor made via an enquiry. Disputes about bookings, deposits, or service quality are between the Couple and the Vendor.

9. WhatsApp and electronic communications

By providing a phone number, you consent to receive service-related messages via WhatsApp (through our provider, Twilio) and, where WhatsApp is unavailable, via email. These may include RSVP confirmations, wedding updates you or your Couple have chosen to send, and account notices.

10. Availability and changes to the Service

We aim to keep BloomWed available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features of the Service at any time, and may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.

11. Termination

We may suspend or terminate your account if you breach these Terms. You may close your account at any time by contacting hello@bloomwed.co.za. Upon termination, your public wedding website or vendor listing will be taken offline; we may retain data as described in our Privacy Policy.

12. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. BloomWed is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including missed RSVPs, delivery failures of WhatsApp or email messages, or disputes with Vendors, except where liability cannot be excluded under South African law.

13. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the South African courts.
